General rental conditions

Article 1 – Purpose

These conditions apply to holiday rentals booked directly on spitimas.fr with SCI SPITIMAS. They cover three options at the villa located in Lunel-Viel (Hérault, France):

  • the apartment for 4 guests;
  • the apartment for 8 guests;
  • the whole villa for 12 guests.

Bookings made on Airbnb or Booking.com are subject to the conditions of those platforms. This English translation is provided for convenience; in the event of any discrepancy, the French version prevails.

Article 2 – Duration

The rental is concluded for a fixed term. The tenant has no right to remain in the premises beyond it. The minimum stay is 2 nights, or 1 night for the apartment for 4 guests. Check-in from 4 pm, check-out before 11 am.

Article 3 – Capacity

The number of occupants may not exceed the capacity booked: 4, 8 or 12 guests. Babies under 2 are not counted. The owner may refuse access to additional people.

Article 4 – Price

Prices are shown in euros, all charges included, with household linen (sheets and towels) included.

The tourist tax is added to the price. It is collected on behalf of Lunel Agglo and paid on site on arrival. As the accommodation is unclassified, it is calculated as follows for each night:

  • the price of the night is divided by the total number of occupants, including children;
  • 7.20% is applied to this amount (5% basic tax, plus 10% for the Hérault Department and 34% additional regional tax, both calculated on that 5%);
  • the result is multiplied by the number of adults, as minors are exempt.

The amount per person per night may not exceed the ceiling set by Lunel Agglo.
Example: villa at €300 per night for 8 adults and 2 children: €300 ÷ 10 occupants = €30; €30 × 7.20% = €2.16; €2.16 × 8 adults = €17.28 of tax per night.

Article 5 – Booking and payment

The booking becomes firm once a deposit of 30% of the price of the stay has been paid by bank transfer.
The balance is paid, as you prefer:

  • by bank transfer or PayPal, no later than 15 days before arrival;
  • in cash on the day of arrival, within the legal limit for cash payments (€1,000 for an individual resident in France).

Article 6 – No right of withdrawal

In accordance with Article L221-28 12° of the French Consumer Code, the rental of accommodation for a specific date does not carry the 14-day right of withdrawal.

Article 7 – Cancellation by the tenant

Cancellation must be notified by email.

  • more than 30 days before arrival: the deposit is refunded;
  • between 30 and 15 days before arrival: the owner keeps the deposit;
  • less than 15 days before arrival, or no-show: the full price of the stay remains due.

Late arrival or early departure does not give rise to any refund.

Article 8 – Cancellation by the owner

If the owner cancels the booking, the owner refunds the tenant all sums paid in full.

Article 9 – Holiday rental insurance

No security deposit is required. In return, the tenant must be insured against rental risks (water damage, fire, broken glass) during the stay. The tenant provides a holiday rental insurance certificate no later than the day of arrival; failing this, access to the accommodation may be refused.
The tenant remains liable for any damage caused during the stay.

Article 10 – Use of the premises

The tenant agrees to occupy the premises peacefully and to leave them clean and in good condition.
If the accommodation is not left clean, a cleaning fee is charged on departure: €60 for the apartment for 4, €90 for the apartment for 8 and €150 for the villa.

Rules:

  • pets are not allowed;
  • parties and events are not allowed;
  • the accommodation is non-smoking: smoking indoors is prohibited;
  • please keep noise down out of respect for the neighbours, especially after 10 pm.

Article 11 – Pool

The pool is open from 1 May to 30 September; outside this period, it is closed. It is unsupervised. It is reserved for occupants and used entirely at their own risk. Children must remain under the constant supervision of an adult. When renting a single apartment, the pool is shared with the occupants of the other apartment.

Article 12 – Complaints and mediation

Any complaint should be sent to contact@spitimas.fr. If no amicable agreement is reached, the tenant may use a consumer mediator free of charge, whose contact details will be given on this page. French law applies.
